For as much as people dismiss them for entertaining so-called “frivolous” lawsuits, the civil courts are one of the most democratic institutions in our country. They allow ordinary citizens to stand on equal footing with massive, powerful corporations. In the civil courts, things like income, race, wealth, social standing and sexual orientation are checked at the door. It’s a place where negligent individuals and corporations can be made to pay for their crimes, even when the criminal courts fail to do so to the satisfaction of the victims.
That’s the idea behind a recent case against one of the biggest cable television and Internet companies in the United States. One of its employees was driving a company van when he allegedly turned left, slamming into a man on a motorcycle. The man was rushed to the hospital for treatment and the staff was able to keep him alive for several days, but he succumbed to his injuries within a week.
The driver of the cable company’s van was cited for failing to yield at an intersection. The deceased man’s widow has contracted an attorney and is suing the cable company for the wrongful death of her husband. She is asking the company to provide compensation for medical bills and the pain and suffering she and the man’s three sons have had to endure because of his death.
